Disinherited?

Many of the clients I represent file a will contest because they have been disinherited or otherwise excluded from the estate. I work closely with these clients to uncover evidence that demonstrates that the deceased intended to include the client in the will or in the distribution of assets from the estate. In other situations, I work to show that the deceased lacked the necessary mental capacity at the time the will or trust was prepared and executed to legally make such decisions.

I also develop evidence that may demonstrate undue influence or duress used to manipulate the deceased. In a few cases, there may be outright fraud by some to extract additional distributions from the estate.

Other Issues With Estate Distributions

I handle other disputes for parties that have an interest in an estate, including:

  • Creditors’ refusals. I represent clients in situations where creditors are owed money by a decedent and seek to open the probate estate in order to secure payment of the debt.
  • Spousal refusals. I handle cases involving spouses or widows who have paid debts greater than the value of the estate. Customarily, these debts are paid off, but not in full.
